TERMS & CONDITIONS

In the following terms & conditions, “the photographer” shall mean Sebastian Xavier trading as Seb Xavier. 

“Non-Conceptual Shoots" refer to photoshoots with a simple premise, simple lighting & little to no pre-production needed for the Photographer, i.e. the basic package: two looks, simple backdrop.

"Conceptual Shoots" refer to photoshoots that would require longer pre-production (including but not limited to, prop making, set building & storyboarding) and longer post production time (including but not limited to, mixed-media, special effects & compositing) , i.e. album artwork, narrative based work, editorials.

These terms & conditions cannot be varied in any way by the clients unless such conditions are expressly agreed by the photographer in writing.

1. COPYRIGHT

i. The copyright Designs and Patents Acts assign the copyright of the images to the photographer.

2. DISPLAY

i. The client(s) hereby allow(s) the photographer to display any photograph covered by this contract and to generally promote the business in advertising, brochures, magazine articles, websites, sample albums etc.

ii. The client(s) cannot re-edit or alter the image in any way (unless given permission to do so by the photographer)

3. PAYMENT

i. A non-refundable deposit fee of 50% of the agreed price will confirm the client's booking, as well as full acceptance of the terms and conditions as published on the photographer's website.

ii. Payment in full of the remaining balance will be due on the day.

iii. Titles to all goods remains with the photographer until paid for in full by the client(s).

iv. All fees are non-refundable unless outlined in the following sections

4. IMAGES

i. The photographer will not send un-edited photos (RAWs) under any circumstance

5. FORCE MAJEURE

i. In the very unlikely events of cancellation by the photographer or the loss of photos due to technical issues (such as memory card damage), liability shall be limited to a full refund of any fees paid.

6. PERSONAL ACCIDENT

i. Any directions issued to clients, their guests or employees during a photographic shoot are deemed to be at said persons own risk. The photographer cannot be held responsible for any personal accidents during a photographic shoot.

7. DELIVERY

i. The photographer will endeavour to deliver edited photos as quickly as possible. However this could take up to 4-6 months during busy periods.

ii. The photographer will deliver up to 10 images for Non Conceptual Shoots, and 1 image for Conceptual Shoots (unless specified)
